The Practice

Allan Marain's New Jersey practice concentrates on criminal defense. That includes expungement of arrests and convictions, including felony convictions.

Allan is a Senior Instructor with Garden State Continuing Legal Education Services. He has been a presenter in its seminars to New Jersey attorneys of "Expungements under New Jersey Law". New Jersey County and local law enforcement agencies have sought his advice concerning application of New Jersey Statutes and Court Rules relating to expungements. His article, Expungement of Criminal Proceedings, was featured in the February 2005 edition of "New Jersey Lawyer Magazine," published by the New Jersey State Bar Association. That article continues to guide New Jersey lawyers seeking expungements for their clients.

Allan also handles drug charges, DWI charges, forfeitures, and driver license suspensions imposed by the Motor Vehicle Commission. He handles New Jersey charges and federal charges. He handles trials and appeals. New Jersey criminal expunge records arrested and convicted He is among the highly experienced and responsive expungement attorneys in New Jersey. Law & Politics Magazine, and the publishers of New Jersey Monthly, have included Allan Marain on its list of New Jersey's “Super Lawyers” in six different years. A 2013 Joint Resolution of the New Jersey Legislature recognized him, stating, “Within all the spheres of his life and work, Allan Marain has established a model to emulate and set a standard of excellence towards which others might strive[.]”

Mr. Marain gives every client individualized attention for the expungement of a felony conviction. He returns all client telephone calls and responds to all letters. Evening appointments are available.

Between 1989 and 1997, Allan Marain was an Assistant Deputy Public Defender in Middlesex County. In that capacity, he handled innumerable theft, drug, burglary, sexual assault, arson, kidnapping, and murder cases. Allan resigned when his Public Defender workload became so great that he was no longer able to give each of his cases the time and attention it needed. The private practice to which Allan returned provided that opportunity.

Allan is admitted to practice before all New Jersey State Courts, and before the United States District Court for the District of New Jersey. Also the United States Court of Appeals for the Third Circuit, the United States Court of Appeals for the Federal Circuit, the United States Tax Court, and the United States Supreme Court.

Allan belongs to the New Jersey State Bar Association, where he is a past chair of both its Criminal Law Section and its Municipal Court Practice Section. He is a member of the Legal Committee of NORML (National Organization for Reform of Marijuana Laws). Allan helped found NORML-NJ. In fact, he was one of its incorporators.

Allan also belongs to the National Association of Criminal Defense Lawyers. He is a former trustee of the Association of Criminal Defense Lawyers of New Jersey. He is a former trustee of the Middlesex County Bar Association. He is a present member of the Middlesex County Assignment Judge's Criminal Lawyers Committee.
